Restructuring and insolvency for charities

We have a dedicated team of experts who deal specifically with restructuring and insolvency within the charitable sector. We work alongside charities, their trustees and management and offer a wide variety of services to them.

 

Our charity restructuring and insolvency services include

  • Financial options review – looking at the various options available to the charity, ranging from merger, sale, alternative funding sources, to various possible insolvency options
  • Advice to trustees – including risks to them personally and possible mitigation actions which they can take, and supporting trustees and the charity in their discussions with key stakeholders, such as its bank, any defined benefit pension scheme, or a funder
  • Pre-borrowing advice – such as analysis of any working capital loan or proposed significant capital expenditure, providing critical review of the project and proposed borrowing
  • Mergers and disposals support – undertaking this through an insolvency process
  • Controlled wind down of operations – we can discuss the options with management, and advise on strategy including insolvency options
  • Liquidation, administration and other insolvency procedures – we can take the appointment as liquidator (or equivalent insolvency process) as part of the wind down process, subject to there being no insurmountable conflicts of interest

  • Members’ or creditors’ voluntary liquidation of various educational establishments
  • Administrators of a charitable company running a special needs education school
  • General advisory work to unincorporated associations
  • Advisory support to a number of charities on their financial options when they have a large deficit on their defined benefit (including final salary) pension scheme
  • Advisory work for a national UK charity delivering support for people with mental health difficulties
  • We have also acted for various national and governmental funders and undertaken financial reviews of charities
